This Customer Agreement is an agreement between you (Customer, User of this site) and lobelpower.com (Site, App, We, Us) that states the terms and conditions under which you may use the Site or App and receive Lobel Solar Power System service.
These Terms and Conditions and Privacy Policy are effective upon acceptance in registration for new registering users and are otherwise effective from 01 March 2013 for all users. By registering/signing up on the website or our mobile app you confirm that you have read and agreed to these Terms and Conditions and the Privacy Policy. If you do not agree to these Terms and Conditions and/or our Privacy Policy, please do not register for or use lobelpower.com.
If you are under 18, you may use lobelpower.com mobile app and website only with the involvement of a parent or guardian.
1: Use of the lobelpower.com Site and Lobel Solar Power System Mobile Application:
Membership on the Website/application is free of charge for your personal use subject to these Terms and Conditions and our Privacy Policy. Lobel Solar Power System does not charge any fee for browsing on the Mobile APP. In particular, Lobel Solar Power System may at its sole discretion introduce new services and modify some or all of the existing services offered on the Mobile APP. In such an event Lobel Solar Power System reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee and Credit policies shall be posted on the Mobile APP or Website or both and such changes shall automatically become effective immediately after they are posted on the Website or App. Unless otherwise stated, all fees shall be quoted in Indian Rupees.
Non-payment: Lobel Solar Power System reserves the right to issue a warning, temporarily /indefinitely suspend or terminate your membership of the Website or App and refuse to provide you with access to the Mobile APP in case of non-payment of fees by you to Lobel Solar Power System. You shall not attempt to or circumvent or manipulate the billing process or Fees owed to Lobel Solar Power System incorporated by way of reference in this Agreement.
2. Your Account:
You agree to provide Lobel Solar Power System with accurate and complete information as required by registration for Lobel Solar Power System Service including, but not limited to, your legal name, billing and shipping addresses, telephone/mobile number. You will remain liable for any use of the Lobel Solar Power System Service until you notify Lobel Solar Power System of the unauthorized use, loss, or theft.
3. Usage of the Mobile Number of the User:
Lobel Solar Power System may send order confirmation & update the customer on the order status and any further order information via SMS (short messaging service) or call on the mobile/Landline number given by the customer at the time of ordering. The customer hereby unconditionally consents such intimation via SMS/Call by Lobel Solar Power System in accordance with the ‘Do not disturb’ guidelines of the Telecom Regulatory Authority of India (TRAI) or such other authority in India and abroad
4. Arbitration:
If any dispute arises between you and Lobel Solar Power System during your use of the mobile app or thereafter, in connection with the validity, interpretation, implementation, or alleged breach of any provision of the Customer Agreement, the dispute shall be referred to a sole Arbitrator, who shall be an independent and neutral third party identified by Lobel Solar Power System. The place of arbitration shall be Ahmedabad (Gujarat). The Courts at Ahmedabad shall have exclusive jurisdiction in any proceedings arising out of this agreement.
The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.
5. Indemnification:
You agree to defend, indemnify and hold Lobel Solar Power System and its Associates harmless from any claims and expenses, including attorney’s fees, arising in connection with a violation of this Agreement by you or through use of your account. The limitations and exclusions in this section apply to the maximum extent permitted by applicable law.
6. Privacy:
The use of the Site is governed by our Privacy Policy, which can be located at the Privacy Policy section.
